All Realms offline, Legacy Legal problem as stated by Nico (Owner)

Quote:
I've said I would give you guys an update on the events leading up until today so, here goes.

I've had this document on my desktop doing stuff, thinking about what I wanted to say, walking away, coming back but here goes. Some of you know and others don't how Legacy came to be. I left scape because peyton basically lost her mind, after she came back from a month hiatus, and frankly, the crap that she was doing, turned my stomach. I started Legacy on the sly, keeping things quiet, I mean the circle of people in the know was less then 10, and actually it was, myself, desire, darknation, taz, rob, and like 3 of my friends at scape. I left scape, but didn't really wish them any ill-will.

Legacy grew and shrank, and was open for about a year and a half, but our user base dwindled over time, until finally, I decided I was going to shut it down. Which I did after a couple weeks of empty servers. By that time, the only 2 people still active on the entire network was myself and elisea. The day, and I mean within hours of me closing down Legacy (v1) Silent sent me an msn asking me to come work for him at ConflictWoW as the staff manager, which, after a few hours of deliberation I agreed to do. Things were going ok, not great, it was a small, but committed community. I met ( and from what I've been told scared the shit out of) Hacker, and Weber.
Things were going fairly well, if relatively small, no great shakes, just another server in the world, another SMALL server. About 4 months in, my cell phone blows up, Rob ( one of the staff) keeps calling me until I answer ( I was at work) the network is down, and no one can get into any of the equipment. As I was about 15 minutes from the house, I was all "fine, I'll be right there to see what I can do"I get home, weber is trying to upload the site to restore it, and as fast as he can, it's being deleted on the webserver. Hours later, when I finally get in touch with Silent, he tells me that he's gone to work for Peyton, but part of that agreement is that he takes down conflict.

several heated minutes of discussion later, I convince silent to give me the character DBs so everyone wouldn't lose their toons.

Weber wasn't sure what was going on, Pudgemuffins ( One of the other owners of conflict) was as much in the dark as everyone else, but couldn't be bothered to even think about it at that time. Hacker, the other owner, who controlled the actual money for conflict, said he would be game to turn the last bit of donations over, and get another network running ( Legacy v2)

We launched legacy less then 24 hours later, using the character DBs we'd gotten from conflict, and by grabbing my old game server, from my friend ( and owner of the company we were hosted at) Chris. Legacy grew and shrank, but in general the population increased, just not at a dramatic pace.

About 3-4 months later ( give or take, I'm old and I can't really remember atm) Silent sent me an msn, saying he realized he'd made a horrible horrible mistake, and wanted to come over to Legacy. He'd said he'd been working on a BG realm that worked, and everyone loved. We went back and forth, and finally decided that it would be worth a shot. The cost for this? Silent would become a part owner with Hacker and myself.

OK phew, that's all ancient history.

Legacy, like all other private servers has had it's highs and lows in population. We've been #1 on the top100 and we've been real low. Personally I don't care, that was Silent's thing.
All in all I've been happy with our growth.

Now to the events.

Friday, I received a frantic msn from Elisea, saying that everyone's access had been pulled, she'd thought we'd been hacked. I found it hard to believe, since I'd set in place a couple security things that shouldn't have been able to be circumvented, but... yeah. My account was gone, my access to all the equipment was gone, and worse yet, the provider was hours away from the datacenter (and his phone, which the nitwit left at home that particular day) As I was getting ready to walk out the door to an appointment, there was little I could do at that time, except for get information. Find out who was doing what. Some of you were here, you saw the posts. I never really had time to read them, but yeah, it was a real mess. The entire time, I had people on the inside getting information as to the plans, and about 10 that night, the provider called me on my cell, you know the guy that I started the server up with from way up there? yeah him. After about 30 seconds of me crawling so far up his anal cavity I got a good glimpse of his upper digestive tract, he pulled all the equipment offline. Since the business dealings of Legacy, have always gone through me, and since I had hacker firmly on my side, I told him to keep the equipment down until he heard from me. The deds were null ported ( but the game servers left running) the web server taken off line, until I could resolve the issue of silent, changing the registrar data at godaddy.

WoWLegacy.net, the domain name, was purchased by me, in 07, I renewed it in 09. I maintain sole responsibility for the domains. I mean I paid for them with my CC. All the owners shared access to that account, and so Silent, thinking to be slick, changed all the information, admin, contact, and technical to himself, changed the email, changed the password, and locked me out of that account as well.

Let me tell you how well that went over... Like a fart in church.Fortunately, since I'd paid for them with a CC and my name has been on the account since it was started, godaddy has certain procedures that they follow, forms, a trip to the legal department, lawyers, etc. Since 06, stuff like this has become a felony, and carries a 2 year sentence in a federal pen. There were so many laws broken it wasn't even funny, but regardless, all I wanted back was my domain name.

I talked to Silent yesterday, gave him the facts. I told him what godaddy told me, what the techs had told me, told him part of the information that they gave me to read, told him about what the legal department said, and whether he believed me or not, finally after about an hour and a half of talking ( and I use that term loosely) he gave me back the domains.

Now, part of it was that he wanted the game servers back up and running, and I almost lied, but I told him I wasn't discussing anything further until I had the domains back. Which he finally did, and I promptly changed all the information over, over the course of the next hour and a half. I then had safeguards put on the domain so that no one, but myself personally, could ever change the information on the site ever again.

Since the game servers have never been "down" it's only a little lie, I hate lying. If you were to count up the times silent has screwed me, this was the third, and last time, so while it was kind of a shitty thing to do, personally I feel it was justified.

As for all the allegations of people taking money from the alertpay account, well....

Fact#1. I don't have an alertpay account.
Fact#2. Silent in months of asking has never provided a financial report to myself or hacker, even tho we've asked numerous times.
Fact#3. The only person that has transferred money out of the alerpay account was Silent, who sent it to himself.
re fact3: Please don't make assumptions, while we don't know where the money went, we're looking for a trail on what it would have been spent on. I won't say

he stole the money because frankly at that time he was an owner and he couldn't "steal" the money, only misappropriate it.
Fact#4. Once Silent relinquished the domain information, and things were safely back under control, and the situation had calmed a bit, In a meeting of the owners of SNHSolutions, which owns wowlegacy, he was voted out of a position of power, and all his powers and privileges related were rescinded.

Besides the fact that he illegally took over the domain, he also deleted my and hacker's account, removed all of our posts, and removed our access to all of our equipment, without our knowledge without our consent. He ( or his merry band of asshats) deleted all the accounts on the vent server, cleared the ban list, removed everyone's access on the vent. He ( and his merry band of asshats) demoted all the staff, removed all their access on the forums. Whatever his reasoning, it went against the very basic charter we set in place when we formed the ownership group and subsequently left us no choice but to remove him.

So currently I am working on restoring the forums, when I get done, I will move to the servers, changing sql passes, making sure no other programs are running besides what is supposed to be running, and then, and ONLY then, will I put up the game servers for everyone else.

The steps I took are drastic, I won't deny that. I personally feel they were warranted. hopefully everyone understands.
